Prison Term Imposed on Woman in Her Thirties for Falsely Accusing Father of Rape, Reflecting Enhanced Legal Sanctions

A woman in her 30s has been sentenced to a prison term for falsely accusing her biological father, who funded her international education, of rape following his refusal to provide her with financial support.

As disclosed by legal sources on the 1st, Criminal Division 1 of the Namyangju Branch of the Uijeongbu District Court (Presiding Judge Choi Chi-bong) recently sentenced a woman identified as A to 10 months in prison. Charges included defamation, obstruction of business, and insult.

A faced prosecution for posting defamatory content online 11 times from May to June last year, under the title "I am a victim of familial sexual violence. Please look at this," against her father, B.

In these posts, she alleged falsely, "I have been continuously sexually assaulted by my biological father since I was four years old, and my mother also suffered domestic and sexual violence," claimed a settlement for "30 million won in damages," and demanded "severe punishment."

Furthermore, she revealed B's real name and business details, adversely affecting his business operations.


 


In addition, A made six other posts accusing B of remarrying a woman, C, with whom he allegedly had an affair.

In February 2021, A initiated a lawsuit for damages concerning sexual assault against B at the Incheon District Court. However, she was unable to substantiate any unlawful conduct.

During the criminal proceedings, A maintained that her allegations were truthful, but the court dismissed her assertions, referencing the lawsuit's outcome. The court noted an absence of evidence or circumstances supporting her claims of habitual sexual assault by B.

Moreover, the court deemed A's accusations baseless, considering the financial assistance she received from B during her overseas education and afterward. Her rape allegation emerged shortly after her financial demand for a cafe venture was rejected by B.


The court underscored, "She disseminated false information about the victims due to her dissatisfaction with being denied financial aid. The reputations of the victims have suffered irreparable harm."


Further justifying the sentencing decision, the court stated, "Given the elevated risk of reoffending, evidenced by her continued similar postings post-crime, and the victims' strong plea for stringent punishment, these aspects were thoroughly assessed."
